Terms of Use

Welcome to GabrielsLoftPhotography.com, owned and operated by Gabriel’s Loft Photography (“Gabriel’s Loft,” “we,” “our,” or “us”). By accessing our website, booking a photography session, making a payment, submitting information, or using any services offered through this website, you agree to be bound by these Terms of Use.

If you do not agree with these Terms, please do not use this website or book services with Gabriel’s Loft Photography.

1. Our Services

Gabriel’s Loft Photography provides photography services, including but not limited to portrait sessions, maternity sessions, birthday sessions, graduation sessions, beauty and fashion sessions, headshots, family sessions, group sessions, creative sessions, studio photography, photo editing, digital galleries, and related services.

All services, packages, pricing, availability, turnaround times, and deliverables are subject to change at any time without prior notice. We reserve the right to update, modify, pause, or discontinue any service or offer listed on our website.

2. Who May Use This Website and Book Services

You must be at least 18 years old, or the age of legal majority in your location, to book services or enter into an agreement with Gabriel’s Loft Photography. If a session involves a minor, the parent or legal guardian must complete the booking and is responsible for all decisions, payments, permissions, and conduct related to the session.

By using this website or booking our services, you confirm that you have the legal authority to enter into this agreement.

3. Bookings, Payments, and Deposits

To reserve a session, clients are required to complete the booking process and submit the required deposit or payment listed at checkout.

All deposits are non-refundable, regardless of the reason for cancellation, missed appointments, scheduling conflicts, emergencies, change of mind, dissatisfaction with personal appearance, or any other circumstance. A deposit secures your selected date and time and removes that availability from our calendar.

Remaining balances, if any, must be paid according to the instructions provided at booking, before or at the time of service. Gabriel’s Loft Photography may refuse to begin or complete a session until the balance is paid in full.

Prices listed on the website are subject to change. Pricing errors may be corrected at any time. Additional fees may apply for extra people, late arrivals, extra edits, special requests, extended time, rush delivery, custom sets, or services not included in the original package.

4. Cancellations, Rescheduling, Late Arrivals, and No-Shows

Because photography sessions are scheduled by appointment, clients are responsible for arriving on time and prepared for their session.

Deposits are non-refundable. Rescheduling may be allowed at our discretion based on availability and the timing of the request. Reschedule requests are not guaranteed.

If you arrive late, your session may still end at the originally scheduled time. Lost time due to lateness is not guaranteed to be made up. If you fail to appear for your session, your payment or deposit may be forfeited, and a new booking may be required.

Gabriel’s Loft Photography reserves the right to cancel or reschedule a session due to emergencies, unsafe conditions, illness, equipment failure, weather, studio issues, or circumstances outside of our control. If we must reschedule, we will make reasonable efforts to provide a new available date.

5. Client Responsibilities

Clients are responsible for reviewing all package details, policies, dates, times, locations, and instructions before booking.

Unless otherwise discussed in writing, clients should arrive hair and makeup ready, dressed and prepared for the session. Clients are responsible for bringing any personal wardrobe, accessories, props, products, or materials they want included.

Clients are also responsible for the conduct of anyone they bring to the studio or session, including children, guests, assistants, or additional participants. Any damage to studio property, props, furniture, equipment, or facilities caused by the client or their guests may result in additional charges.

6. Studio Rules and Safety

We reserve the right to refuse, stop, or cancel service if a client or guest behaves in a way that is unsafe, threatening, disrespectful, disruptive, intoxicated, abusive, harassing, or damaging to the studio, staff, equipment, or others.

No illegal activity, weapons, violence, harassment, or unsafe behavior is permitted on the premises. Gabriel’s Loft Photography may remove any person from the studio or session at our discretion.

7. Photo Delivery, Galleries, and Turnaround Times

Delivery timelines vary depending on the package, editing workload, holidays, studio schedule, and any custom requests. Unless otherwise stated, unedited images may be delivered through an online gallery, and edited images are delivered according to the package selected.

Standard edited image turnaround is typically 7–10 days, unless a different timeline is stated in your package or agreed to in writing. Rush delivery is only included when specifically purchased or confirmed.

Online galleries may be available for a limited time. Clients are responsible for downloading and safely storing their images once delivered. Gabriel’s Loft Photography is not responsible for lost downloads, expired galleries, client device issues, or failure to save files after delivery.

8. Edits, Retouching, and Creative Style

Gabriel’s Loft Photography provides creative photography and editing services based on our professional style, artistic judgment, and brand standards. By booking, you acknowledge that photography is a creative service and that final images may vary based on lighting, posing, wardrobe, backdrop, client cooperation, session time, editing style, and other factors.

High-end edits may include professional retouching such as skin smoothing, color correction, lighting adjustments, and general enhancement. Specialty edits, composites, digital backgrounds, body alterations, object removal, or major retouching may require an additional fee.

Extra edits are available for purchase at the current listed rate. Requests that fall outside the original package may result in additional charges.

9. Refund Policy

All deposits are non-refundable. Payments for completed photography services, digital images, edited images, rush services, custom work, or downloadable products are generally non-refundable.

Because photography services involve reserved time, creative labor, studio preparation, digital delivery, and custom editing, refunds are not guaranteed once a session has been booked, started, completed, or delivered.

If you have an issue with your session or final images, please contact us so we can review the concern. Any resolution, remake, credit, partial refund, or additional edit is offered solely at the discretion of Gabriel’s Loft Photography.

10. Chargebacks and Payment Disputes

By booking and paying for services, you agree that the payment is authorized and that you understand the deposit, cancellation, rescheduling, and refund policies.

If you file a chargeback or payment dispute after receiving services, booking a session, missing a session, or violating these Terms, we reserve the right to provide documentation to the payment processor, including booking records, signed agreements, messages, invoices, proof of delivery, gallery access, and other relevant records.

11. Intellectual Property and Copyright

All images, photographs, videos, graphics, website content, logos, text, designs, branding, and creative materials created by Gabriel’s Loft Photography remain the intellectual property of Gabriel’s Loft Photography unless otherwise agreed in writing.

Clients receive permission to use delivered images for personal use, social media, printing, and sharing, unless a separate commercial license is purchased or granted in writing.

Clients may not sell, license, edit, alter, apply filters to, reproduce for commercial use, submit for publication, use in paid advertising, or provide images to third parties for business purposes without written permission from Gabriel’s Loft Photography.

When posting images online, credit to Gabriel’s Loft Photography is appreciated.

12. Client-Provided Content

If you upload, send, or provide any images, logos, artwork, music, references, text, props, wardrobe, or other materials to Gabriel’s Loft Photography, you confirm that you own the rights or have permission to use those materials.

You agree not to provide materials that violate copyright, trademark, privacy rights, or any law. You are responsible for any claims related to materials you provide.

13. Portfolio, Marketing, and Promotional Use

Unless otherwise agreed in writing, Gabriel’s Loft Photography may use images from sessions for portfolio, website, social media, advertising, studio displays, promotional materials, and other business purposes.

If you have privacy concerns, sensitive circumstances, or do not want certain images shared publicly, you must notify us in writing before your session. For sessions involving minors, the booking parent or legal guardian is responsible for granting or limiting permission for image use.

14. SMS, Email, and Promotional Message Opt-In

By submitting your phone number, email address, booking a session, completing a form, texting us, or otherwise contacting Gabriel’s Loft Photography, you agree that we may contact you regarding your booking, appointment reminders, payment updates, gallery delivery, customer support, policy updates, and other service-related communications.

If you choose to opt in to SMS/text messages, you consent to receive text messages from Gabriel’s Loft Photography at the phone number you provide. These messages may include booking confirmations, appointment reminders, rescheduling updates, payment reminders, gallery notifications, customer support replies, special offers, promotions, and studio announcements.

Consent to receive SMS messages is not required as a condition of purchasing any goods or services. Message frequency may vary. Message and data rates may apply depending on your mobile carrier.

You may opt out of SMS messages at any time by replying STOP. You may request help by replying HELP or contacting us directly.

Gabriel’s Loft Photography does not sell, rent, or share SMS opt-in information or phone numbers with third parties or affiliates for marketing or promotional purposes. Information may be shared only with service providers when necessary to deliver messages, process bookings, provide customer support, or operate our business.

By using our website or booking services, you also agree that we may send transactional emails related to your booking, payment, gallery, or service. You may unsubscribe from promotional emails at any time, but we may still send necessary service-related communications.

15. Website Use

You agree not to misuse this website, attempt unauthorized access, interfere with website security, copy website content, scrape information, upload malicious code, impersonate another person, or use the website for unlawful purposes.

We may suspend, restrict, or terminate access to the website or services at any time if we believe these Terms have been violated.

16. Third-Party Services

Our website may use third-party platforms or services for booking, payment processing, galleries, email, forms, analytics, or other business functions. These third-party services may have their own terms, privacy policies, fees, and processing practices.

Gabriel’s Loft Photography is not responsible for outages, errors, delays, payment issues, gallery issues, or data handling caused by third-party platforms.

17. No Guarantees

We work hard to provide a professional, high-quality experience, but we do not guarantee any specific pose, expression, outcome, reaction, number of favorite images, social media result, business result, or personal satisfaction with appearance, wardrobe, makeup, hair, or styling.

Final results depend on many factors, including preparation, cooperation, lighting, timing, creative direction, and the selected package.

18. Limitation of Liability

To the maximum extent permitted by law, Gabriel’s Loft Photography will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost opportunities, lost data, emotional distress, personal dissatisfaction, or other damages arising from the use of this website or our services.

Our total liability for any claim related to a booking or service will not exceed the amount paid by the client for the specific service giving rise to the claim.

19. Indemnification

You agree to indemnify and hold harmless Gabriel’s Loft Photography, its owner, employees, contractors, assistants, and representatives from any claims, damages, losses, liabilities, costs, or expenses arising out of your use of the website, your booking, your violation of these Terms, your conduct during a session, your guests’ conduct, or any materials you provide.

20. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the website or services after changes are posted means you accept the revised Terms.

21. Governing Law and Disputes

These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles. Any disputes related to this website, bookings, payments, or services shall be handled in the appropriate courts located in Michigan, unless otherwise required by law.
